Terms and Conditions — The Wine Voyage

These Terms and Conditions (“Terms”) govern your use of thewinevoyage.net (the “Site”) and any corporate education, entertainment, or team-building program booked through TWV81 Inc., doing business as The Wine Voyage (“The Wine Voyage,” “we,” “us,” or “our”). By using the Site or booking a program with us, you agree to these Terms.

1. Our Services

The Wine Voyage designs and leads private, closed corporate education, entertainment, and team-building programs themed around wine and spirits, hosted at a location the client selects (such as a private residence, office, or hotel). Our programs are not open to the public. The Wine Voyage’s role is to lead and facilitate the educational, entertainment, and team-building portions of the program — the tasting of wine and spirits is one component of that broader experience, not the product we sell. We do not sell wine or spirits at retail through the Site, and we do not routinely supply or serve alcohol as part of our services — alcohol featured during a program is typically provided by the client or the venue hosting the event. On the limited occasions where The Wine Voyage does supply alcohol for a program, it does so in accordance with applicable law, and the responsibilities described in Section 5 still apply. Programs are generally hosted by our team, and we may occasionally engage independent contractors to assist.

2. Age Requirement

Because our programs include the tasting and discussion of alcoholic beverages as part of the broader experience, all participants must be 21 years of age or older. The client booking the program is responsible for communicating this requirement to attendees and for ensuring compliance with any applicable venue rules regarding alcohol.

3. Bookings, Payment, and Cancellations

4. Client Responsibilities

The client booking a program is responsible for:

  • Providing accurate information about the event, including guest count, location, and any relevant venue restrictions
  • Ensuring the venue permits alcohol service and that any required venue approvals or permits are obtained
  • Ensuring all participants meet the age requirement described in Section 2
  • The conduct of guests attending the program

5. Alcohol as Part of the Program

Alcohol featured during a program is provided and served by the client or the venue hosting the event, not by The Wine Voyage, except on the limited occasions described in Section 1 where The Wine Voyage supplies alcohol directly. In all cases, the client is responsible for ensuring alcohol at the event is served responsibly and in compliance with applicable law, including verifying that all participants are 21 years of age or older. Participants are responsible for their own consumption and conduct, including arranging safe transportation home following a program. The Wine Voyage may pause or decline to continue a program if a participant appears intoxicated or unable to safely participate.

6. Intellectual Property

All content on the Site, including text, graphics, logos, and images, is the property of The Wine Voyage or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from this content without our prior written consent.

7. Third-Party Links

The Site may contain links to third-party websites. We are not responsible for the content, privacy practices, or terms of any third-party site, and inclusion of a link does not imply endorsement.

8. Disclaimer of Warranties

The Site and our services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by law.

9. Limitation of Liability

To the fullest extent permitted by law, The Wine Voyage shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or participation in a program, including but not limited to property damage, personal injury, or loss arising from alcohol consumption, except where caused by our gross negligence or willful misconduct.

10. Indemnification

You agree to indemnify and hold harmless The Wine Voyage, its owners, employees, and contractors from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, your booking, or your or your guests’ conduct during a program.

11. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of law principles.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by updating the “Last Updated” date at the top of this page. Continued use of the Site or booking of a program after changes are posted constitutes acceptance of the revised Terms.
